  • Are there less restrictive alternatives available, such as a power of attorney?
  • If guardianship is necessary, we decide on the type needed: Guardian of the Person, Guardian of the Estate, or perhaps a more limited scope.

Let’s dive into Step D: Court Investigation and Evaluation

“Ah, yes,” Ted says with a smile. “This is where the court really gets involved. They appoint an investigator or guardian ad litem, essentially a neutral party, to assess the situation thoroughly. This investigator interviews the proposed ward, reviews their living environment, and gathers input from family members, caregivers, and professionals. They might even recommend a medical or psychological evaluation to determine decision-making capacity.”

“The investigator’s findings are crucial because they inform the judge’s decision.” Ted adds. “Their report provides a comprehensive picture of the individual’s needs and whether guardianship is truly in their best interests.”

Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
