Hello, and welcome back to our segment on local legal experts. Today we’re joined by Steve Bliss, a highly respected probate attorney here in Moreno Valley. Steve, thanks so much for taking the time to speak with us.
Understanding Testamentary Trusts
Steve, many people are familiar with the concept of a will, but what about testamentary trusts? Can you explain how these differ from a traditional will?
Certainly. A testamentary trust is created through a will and takes effect only after the grantor, or the person who creates the trust, passes away. Unlike a living trust that avoids probate, a testamentary trust goes through the probate process. Consequently, this means it can be a bit more time-consuming and costly to administer than a living trust.
Nevertheless, there are situations where a testamentary trust is a valuable tool. For example, if you have minor children or beneficiaries with special needs, a testamentary trust can ensure that their inheritance is managed responsibly and used for their benefit according to your wishes.
- Provides ongoing financial support for minors
- Protects assets for beneficiaries with disabilities
- Offers flexibility in terms of asset distribution
Moreover, a testamentary trust can be structured to distribute assets over time, rather than all at once. This can help prevent beneficiaries from squandering their inheritance and ensure that it lasts for many years.
Navigating Challenges with Testamentary Trusts
Steve, I imagine there are times when setting up or administering a testamentary trust presents unique challenges. Can you share any experiences?
While testamentary trusts offer great benefits, there have been instances where unforeseen circumstances arise. For instance, I once worked with a family where the father had created a testamentary trust for his son who was struggling with addiction. Unfortunately, the son passed away before his father.
This presented a heartbreaking dilemma. Ordinarily, the trust assets would have gone to the son. However, given the circumstances, we needed to explore alternative options. Ultimately, we worked closely with the family and a court-appointed guardian to ensure that the trust funds were used responsibly to cover the son’s outstanding debts and funeral expenses.
It’s important to remember that estate planning is not just about legalities; it’s about compassionately addressing individual family dynamics and ensuring that everyone’s best interests are protected.
The Importance of Professional Guidance
Clearly, testamentary trusts can be a complex legal tool. What advice would you give to our viewers who might be considering this option?
I strongly encourage anyone contemplating a testamentary trust to seek guidance from an experienced probate attorney. According to the American Bar Association, approximately 60% of Americans don’t have a will or estate plan in place. An attorney can help you understand the intricacies of testamentary trusts and determine if they are the right fit for your circumstances.
We strive to make the process as clear and stress-free as possible for our clients at Moreno Valley Probate Law. Our team takes the time to listen carefully to your needs, answer all your questions, and develop a customized estate plan that reflects your values and protects your loved ones.
