Ted smiles warmly. “Well, it wasn’t a single ‘aha!’ moment, but rather a growing realization. As I gained experience in different legal fields, I noticed a recurring theme: elders were often vulnerable and easily exploited. It felt deeply unfair, and I wanted to use my skills to make a difference in their lives.”

Let’s Dive Deeper into “Protective Actions.” What Does That Entail?

“That’s where the rubber meets the road,” Ted says, leaning forward. “Protective actions are often urgent and require swift decision-making. We might need to file for restraining orders against abusive caregivers, notify Adult Protective Services, or even petition for guardianship or conservatorship if an elder is unable to make sound decisions for themselves.” He pauses, reflecting. “It’s about creating a safe haven and ensuring the elder’s well-being.

For instance, we had a case involving an elderly gentleman who was being financially exploited by his own son. We were able to freeze the son’s access to his father’s accounts and ultimately recover the stolen funds. It was incredibly gratifying to see justice served and the elder protected from further harm.”

“Another time,” Ted continues, “we worked with an elderly woman who was suffering from dementia and being neglected in a care facility. We intervened quickly, secured her transfer to a more reputable facility, and ensured she received the proper medical attention she needed.”

Any Challenges You’ve Faced While Implementing Protective Actions?

Ted nods thoughtfully. “Absolutely. It can be challenging navigating complex family dynamics and dealing with resistant parties who may prioritize their own interests over the elder’s well-being. Sometimes, we encounter legal roadblocks or have to overcome misinformation and skepticism.”

He recounts a situation where an elder was being pressured by a distant relative to sign away control of their assets. “It took careful investigation, persuasive arguments, and collaboration with other professionals like social workers and doctors to ultimately convince the court to protect the elder’s autonomy,” Ted explains.
